Public Notice: COVID-19 HUD Waivers Update

This Public Notice is to inform all interested persons that in response to the COVID-19, HUD has issued a series of waivers providing public housing authorities and its residents temporary protection from certain regulations. HUD first issued a set of waivers in April 2020, many of which Lucas Metropolitan Housing ("LMH") adopted. These may be found in the Latest News section of this website, in a release dated May 11, 2020.

In July 2020, HUD issued a new notice, which maintained all these waivers and extended waiver deadlines. Pursuant to this new notice, LMH maintained all originally adopted waivers and implemented all deadline extensions. These are incorporated by reference into this notice.

The new notice also added additional waivers that housing authorities may adopt.

After thorough analysis, LMH has implemented the following additional waivers directly impacting the following Housing Choice Voucher ("HCV") programs and participation effective July 2, 2020:

HCV-11: Family Unification Program (FUP) Length of Assistance for Youth. Allows Public Housing Authorities (PHAs) to suspend terminations of assistance for FUP youth who will reach the 36-month limit between April 10, 2020, and December 31, 2020.

HCV-12: Family Unification Program Timeframe for Referral. Allows PHAs to accept referrals of otherwise eligible youth who will leave foster care within 120 days.

HCV-13: Homeownership: Maximum Term of Assistance. Allows a PHA to extend homeownership assistance for up to 1 additional year for any family that is in the last year of this term (i.e., the 15th year or the 10th year, as applicable) and that is experiencing financial hardship as a result of the COVID-19 pandemic.

HCV-14: Mandatory Removal of Unit from PBV HAP Contract. Allows a PHA to keep a PBV unit under contract for a period that extends beyond 180 from the last HAP but does not extend beyond December 31, 2020.

Please note that all waivers are subject to change based on LMH and HUD policies and procedures during this pandemic.
